The terms that apply to services provided by BRITE LOGISTICS INC.
Last updated: October 2026These Terms of Service ("Terms") govern your use of britelogisticsusa.com and the commercial freight transportation and logistics services provided by BRITE LOGISTICS INC. ("Brite Logistics," "we," "us," or "our") to business customers ("Customer," "you"). By requesting or accepting our services, you agree to these Terms. A separate written agreement signed by both parties will control to the extent it conflicts with these Terms.
1. Services
Brite Logistics provides commercial freight transportation and logistics services, including full truckload (FTL) and less-than-truckload (LTL) transportation, expedited freight, freight distribution, shipment tracking and communication, and warehousing and storage. Our services are provided to businesses and not for personal or household use. Specific services, scope and pricing are confirmed with you in a quote, invoice or written agreement.
2. Customer-provided shipment information
You are responsible for the accuracy and completeness of all shipment information you provide, including pickup and delivery locations, freight description, weight, dimensions, piece count, packaging, handling requirements and contact details. Inaccurate or incomplete information may cause delays, revised pricing or refusal of service. You represent that you have the right to ship the freight you tender and that it complies with applicable laws.
3. Quotes and estimates
Quotes and estimates are based on the information you provide and are not a guarantee of final price, timing or availability. We may revise a quote if shipment details change or differ from what was described, or if additional services or charges are required. A shipment is accepted only when we confirm it to you.
4. Payment terms
Charges for services are payable by invoice. Unless otherwise stated on your quote or invoice or in a written agreement, payment is due as stated on the invoice. Where applicable, we may require a deposit or advance payment before scheduling or beginning service, and we will identify any such requirement to you in advance. Late or unpaid balances may result in suspension of services, and, to the extent permitted by law, we may recover reasonable collection costs. You are responsible for any applicable taxes and for additional charges agreed to or incurred, such as those resulting from changes to the shipment.
5. Scheduling, pickup and delivery
Pickup and delivery dates and times are coordinated with you and are estimates unless we expressly confirm otherwise in writing. You are responsible for ensuring that freight is ready, properly packaged and available at the agreed time, and that the pickup and delivery locations provide reasonable access and necessary personnel. Waiting time, redelivery, additional attempts or similar events may result in additional charges.
6. Customer responsibilities
- Provide accurate shipment information and required documentation
- Package, label and prepare freight appropriately for transportation and handling
- Disclose any hazardous, regulated, fragile, high-value or specially handled freight before tender
- Not tender prohibited or unlawful goods
- Pay invoices according to the agreed terms
- Inspect delivered freight promptly and report any visible loss or damage to us in writing as soon as possible
7. Shipment changes and cancellations
Please notify us as early as possible of any change to or cancellation of a shipment. Changes are subject to availability and may result in revised pricing. If you cancel or change a shipment after we have scheduled or dispatched resources, or after work has begun, you may be responsible for charges incurred, which may include a portion of deposits or advance payments where applicable.
8. Delays
Transportation depends on factors that may be outside our control, including weather, traffic, road closures, equipment or facility issues, regulatory requirements, inspections and acts of third parties. We will make reasonable efforts to communicate regarding delays. To the fullest extent permitted by law, we are not liable for delays caused by events beyond our reasonable control.
9. Freight handling
We will handle freight with reasonable care. Responsibility for freight in transit is governed by the applicable shipping documents, any written agreement between the parties, and applicable law. You are encouraged to consider appropriate cargo insurance for your freight. Claims for loss or damage must be submitted in writing promptly and within the time periods set by the applicable shipping documents, agreement or law.
10. Warehousing and storage
Where we provide warehousing or storage, the specific storage terms, including the freight to be stored, duration and fees, will be confirmed with you in advance. You remain the owner of stored freight. You are responsible for ensuring that stored freight is lawful, accurately described and suitable for storage, and for disclosing any special requirements. We will exercise reasonable care with freight in our custody. To the extent permitted by law, we may enforce a lien on stored or transported freight for unpaid charges. You are responsible for storage charges until freight is released or removed.
11. Limitation of liability
To the fullest extent permitted by law, Brite Logistics will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost revenue, loss of business or loss of goodwill, arising from or related to our services or this website. Any liability we have for loss of or damage to freight is limited to the extent provided in the applicable shipping documents, written agreement or applicable law. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold Brite Logistics harmless from claims, losses and expenses, including reasonable attorneys' fees, arising from inaccurate shipment information, prohibited or improperly described freight, or your breach of these Terms, to the extent permitted by law.
13. Website use
This website is provided for general information about our services. Information on the website is not an offer or guarantee of service. Images on the website are illustrations and do not depict actual Brite Logistics vehicles, facilities, employees or customers.
14. Governing law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising from these Terms or our services will be brought in the state or federal courts located in Illinois, and you consent to that jurisdiction, except where a written agreement states otherwise or applicable law requires otherwise.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows when the current version took effect. Continued use of our services after changes means you accept the updated Terms.
